The mobilized Petersburger-pacifist escaped from the unit. “Paper”

Mobilized Petersburger Kirill Berezin, who refused take up arms and told about threats from the military authorities, escaped from the unit in a taxi and turned himself in to the UK with a confession. About it tells BBC Russian Service.

The escape. Berezin was in the camp of a military unit near the village of Khokhlovo near Belgorod. According to Berezin and his lawyer Nikifor Ivanov, servicemen are free to leave the camp.

According to Berezin, on October 25, the mobilized were told that a unit was moving – he was afraid that they would be taken to Ukraine. After the next formation on October 25, Berezin left his uniform and backpack in the tent, took his passport and military ID, went to the store and agreed with a taxi driver to get to St. Petersburg for 35 thousand rubles. The journey took 22 hours.

Turnout with a confession. According to the law, it is possible to bring a soldier who left the unit to responsibility if he did not appear in the unit for two days or more. Together with a lawyer, Berezin decided to issue a confession to the UK before the expiration of this period.

In the turnout, Berezin indicated that he had no intention of evading service and “was forced to temporarily leave the tent camp due to difficult circumstances.” “I realized that my report on the request to send me to the ACS would not be considered, I was afraid for my life and health due to the illegal actions of Lieutenant Colonel [Анатолия] Smerdov,” he pointed out.

Threats. When contacting the Investigative Committee, Berezin also asked to bring Lieutenant Colonel Smerdov to justice under three articles of the Criminal Code of the Russian Federation: on the threat of murder, abuse of power and excess of power.

Berezina’s girlfriend has already toldthat he was threatened with beating in the military unit. The material of the BBC Russian Service describes these threats in more detail: Smerdov allegedly threatened to knock out Berezin’s teeth and said “why normal boys must die, and you, carrion, must live.” Threats and insults, according to Berezin, were systematic.

Consequence. According to the BBC Russian Service, the investigation decided to check the actions of both Berezin and Smerdov. At the time of the check, the investigator seconded Berezin to a military unit on Vasilyevsky Island. For escaping from the unit during the period of mobilization, the Russians, taking into account the new amendments, could face up to five years in prison.

The pre-investigation check takes 10 days, in exceptional cases it can be extended up to 30 days. As a result, the investigation will issue a decision to initiate a criminal case or refuse to prosecute.

During this time, Berezin’s defense will try to obtain guarantees that the Petersburger will not be returned to the unit near Belgorod. The lawyer is also preparing an appeal in the Berezin case in court and is trying to prove that military personnel during the period of mobilization have a constitutional right to undergo ACS.

Berezin. Kirill Berezin received the summons on 24 September. A few days later, he was sent to a military unit in the Belgorod region without a medical examination or a deferment check. His 69-year-old grandmother is dependent on him. The young man demands to be given the opportunity to perform alternative civilian service, refuses to take up arms and does not agree to fulfill his military duties.

Earlier, Berezin filed a lawsuit demanding that the decision of the military registration and enlistment office be declared illegal. However, on October 18, the Nevsky District Court rejected. According to the defendant, the right to ACS is not a basis for exemption from mobilization.
