Government Decree Defines Formal Signs of Mirrors of Prohibited Online Resources

Published Decree of the Government of the Russian Federation on the approval of the rules for making a reasoned decision to recognize an information resource on the Internet as a copy of a blocked resource.
The rules establish the procedure for Roskomnadzor to make a reasoned decision to recognize a site as an information resource confusingly similar to a site blocked in Russia (a “mirror”, i.e. a mirror image of a blocked site located on a new URL).
The rules also contain similarity criteria for a copy of a blocked information resource and a blocked information resource, which are taken into account when making a reasoned decision.
To recognize a resource as a mirror of a blocked information resource, the following criteria are established:
- general signs of external similarity – such as pattern, font, color scheme, similarity and arrangement of elements, design;
- the presence on the copy of the blocked information resource and the blocked information resource of the information specified in Articles 15.1, 15.1-1, 15.3 and (or) 15.3-1 of the Federal Law “About information, information technologies and information protection» (in whole or in part);
- coincidence of contact data placed on the copy of the blocked information resource and the blocked information resource;
- similarity of domain names;
- similarity of resource names;
- signs of technical interaction of a copy of a blocked information resource and a blocked information resource, including automatic redirection of users from a blocked information resource, synchronization of the position index of a copy of a blocked information resource and a blocked information resource in search results, the use of one control system [сайтом]reserving names on a network address;
- other signs of similarity to the degree of confusion of a copy of a blocked information resource and a blocked information resource.
A reasoned decision must contain the name, domain name, network address and (or) URL of the site pages that allow you to identify a copy of the blocked information resource, the rationale for making a reasoned decision, indicating the criteria.
