The evidence collected by the Main Investigation Department of the Russian Investigative Committee allowed the court to pass a sentence on the former deputy director of the Federal Penitentiary Service of Russia Valery Maksimenko. He will “linger” at his former job for 9 years, but already as a prisoner.

“Maksimenko was found guilty of abuse of power, which entailed grave consequences, and taking a bribe on an especially large scale (part 3 of article 285, part 6 of article 290 of the Criminal Code of the Russian Federation). He was sentenced to 9 years in prison, which he will serve in a strict regime colony and a fine of 43.3 million rubles,” the court decision says.

The investigation and the court managed to establish that in 2018-2019 Maksimenko “in order to conclude in an uncompetitive way state contracts for the construction and repair of facilities of the penitentiary system with companies associated with his acquaintance, gave illegal instructions to the heads of the territorial departments of the Federal Penitentiary Service of Russia not to accept budgetary obligations within the limits and not to start construction”.

The deputy director of the Federal Penitentiary Service “actually forced the territorial departments of the Federal Penitentiary Service of Russia to conclude contracts with the Federal State Unitary Enterprise US NCFD of the Federal Penitentiary Service of Russia, which obviously could not fulfill them.”

“Thus, he disrupted the implementation of the federal target program “Development of the penitentiary system”, and also caused damage to the state in the amount of more than 330 million rubles in just a year. As a result, 19 construction sites were not put into operation,” said Svetlana Petrenko, official representative of the Russian Investigative Committee.

The court noted that Maksimenko “artificially created the conditions for the subsequent conclusion of contracts with companies associated with his acquaintance.”

According to the materials of the criminal case, for his illegal services and general patronage in the service, Maksimenko received a bribe from the specified person in the form of renting a country house for him in the Odintsovo district of the Moscow region for a total amount of about 2.2 million rubles.

Petrenko noted that the investigators checked the enormous amount of work in this case: they checked the execution of more than 100 state contracts for construction and installation and design and survey work under the federal target program on the territory of more than 30 constituent entities of the Russian Federation, interrogated 140 witnesses, conducted more than 10 accounting, phonoscopic and handwriting forensic examinations.

By the verdict of the court, Maksimenko was also deprived of the rank of lieutenant general and the state award.
